When picking a lawyer, it can be difficult to know which one will be a perfect fit. A client needs to consider their needs and wants, then find a reputable lawyer that matches that. Easy right? Well, it's more like “easier said than done.” Between reviews, specializations, track records, and more it can be extremely easy to feel lost and confused. Three Best Rated® wants to help everyone feel a little less lost, and interviewed three award-winning lawyers to learn their tips on what a client should look for in a lawyer!


Specialization

When picking a lawyer, the client should look at what the lawyer specializes in and choose accordingly. “[For example,] a criminal law firm dedicated to criminal law – not as a combined family law firm and not as an add-on to a commercial law firm,” says Michael Perrella, founder of Perrella Legal. Many areas of law are highly specialized and require dedication to be competitive. “People should be wary of lawyers who dabble... [they should have] at least 10 years’ experience specializing in that field,” notes Mr. Perrella. Specializing in a field allows lawyers to be able to pinpoint strengths and weaknesses of particular cases that other lawyers might miss. “[For example] at Testart Family Lawyers we will give you an honest assessment of your case including its weaknesses,” says Marc Testart, founder of Testart Family Lawyers. However, without experience in the field to back up the assessment, it could be inaccurate.

Reputation

With a lawyer, reputation is important! Their reputation with the customers and the members of the judiciary all plays a role in their success. “You want a lawyer who has an excellent rapport with members of the judiciary and prosecutors and fully understands their personalities and understands sentencing trends and court procedures,” Mr. Perrella advises. A lawyer who makes a habit of dismissing or disrespecting judges will have a negative effect on the case. Plus, if a lawyer cannot make an effort to be courteous and professional with the judiciary, how will they treat the client? “There are competent lawyers and others who are not so competent. There are lawyers with big egos, lawyers who put money first, and lawyers who love to put other lawyers down, so they can get the job,” says Michael Kuzilny, founder of MK Law, “Ring around and find someone that best suits your needs.”

Fees and initial consultations

While fees should not be the first thing a client looks for in a lawyer, it would be silly to not factor it in. Different lawyers have different pricing schemes and some will leave the client with a hefty bill at the end. “Look for someone who offers a fixed fee so there is no scope for overcharging,” advises Mr. Perrella. It's important to discuss payment, fees and budgets before signing a contract or hiring the lawyer. Usually a client can discuss this during the initial consultation. “A great lawyer will offer a free, no obligation initial consultation because they are confident about what they can achieve for you,” says Mr. Perrella. The initial consultation is also a great time to identify how the lawyer works and the attitude they have towards the case. “Be clear and organized about your situation, and explain what you are trying to achieve,” advises Testart, “Interview at least two or three [lawyers] and make your decision based upon their initial advice.”

When deciding to buy a house, a person really only has two choices – build a new house or buy an existing house. Both options present a different array of pros and cons, and different concerns every homeowner should consider before deciding on their choice. Three Best Rated® has decided to sit down with an award-winning home building company, an award-winning real estate agent and an award-winning real estate lawyer in order to understand what the customer should know before building or buying a house.

Building a house is a very exciting time for everyone involved. The homeowner is able to have the house designed exactly how they want it to look, with all the features and amenities they want. However, building a home can be very expensive. If the homeowner is on a small budget, they should steer away from building a home. For those who can afford it, they still need to watch out to avoid wasting money. “When clients are making price comparisons between builders/contractors, they need to make sure they are truly comparing apples to apples,” says James Herron of Little Redstone Inc. “Most square foot pricing quoted by builders/contractors does not contain permit/city fees, tree protection fees, architectural design fees, interior design fees, landscape design fees, basement finishing costs or project drawing changes fees.” All these fees add up to a much higher cost per square foot than the homeowner originally planned for. The homeowner needs to be sure they account for these extra costs when budgeting out their new home.

When having the home designed, the homeowner needs to take the finished product into consideration and how the amenities will function in unison. For example, how their HVAC system impacts the overall climate control and humidity levels of the house and the impact to the wood and plaster finishes over time. “A radiant heating system alongside a forced air system should be installed,” James says. “Radiant heating is the best way to heat a house while the forced air system will supply air conditioning and the humidity levels needed to properly maintain the finishes installed. A house that is too dry will guarantee that all the wood finishes will crack and warp.” This will lead to costly, repeating repairs until the problem is addressed and fixed. The homeowner can avoid future headaches by ensuring everything in their new home will work together perfectly.

Finally, the homeowner should vet their potential builders vigorously. The homeowner will want to ensure the company is used to the size and scope of the home and is reputable. First and foremost, the homeowner should know their budget and finances before they even look at a house. “Understanding your financing approval and mortgage options is vitally important,” Ryan says. Nothing is worse than looking at THE house and realizing it won't fit into the budget. Along this same vein, the homeowner needs to ensure they are buying the property the “right” way. “Your agent should have the right skills to make sure you're buying a solid property, at the best price and terms,” Ryan explains. “You'd think this is common sense, but we often come across sellers who have bought a property with another agent, and they paid too much and did not think this through.” This also means that the homeowner should be careful about which real estate agent they use. “You need to have a great team of professionals around you,” Ryan says. “Your agent has to know the market. The market is always changing and is impacted by things such as supply and demand, interest rates, government regulations, school ratings and much more.” A good real estate agent that has a great team behind them will be knowledgeable and up to date on these factors and will be able to get the homeowner the perfect house for the right price.

As Ryan mentioned earlier, the homeowner needs to have a great team of professionals backing them up. They will need lawyers, mortgage brokers, contractors and, of course, a great real estate agent. All these professionals work in unison to ensure the homeowner gets a house they are happy with for many years to come. “[When you buy a house], you need to have ... a good home inspection, financing, conditional sale of property, [verify] zoning, [access the] property survey – to name a few,” Ryan says. “Each situation is unique, and your agent should know how to protect your best interest.” Every step of the way, the homeowner will need help from a professional. They should make sure they read reviews, research the companies and ask questions before they decide on what professional to use. They should “shop around” before deciding on a professional to ensure they pick the one that is the best fit for them.

Whatever path the homeowner chooses, it's always a great idea to have a real estate lawyer on their side. Real estate lawyers help their clients navigate the ever-changing laws of real estate, whether it's purchasing, selling or simply mortgage financing. It is good to see the lawyer as an extra safety net to make sure the client doesn't make a costly mistake when buying a home. “Purchasing a home can be a very stressful procedure for a client, particularly a first-time buyer, and the ongoing help and advice of a good and empathetic real estate lawyer throughout the process can go a long way towards alleviating the stress,” Jonathan says.

Any responsible person knows to plan for the worst while hoping for the best. Nobody wants to think about creating an estate plan and facing their own mortality until they are very old. However, it's the responsible thing to do. When someone passes away without an estate plan, it means they have no input to what happens with their possessions or money; the province will decide how the assets are distributed. This will lead to extra expenses and often takes a long time to resolve. Many people have never set up an estate plan and wouldn't know the first thing to do. This is why Three Best Rated® sat down with two award-winning estate lawyers and an award-winning financial advisor to learn three mistakes to avoid with an estate plan.

1. Not Having a Will

A person is (almost) never too young to have a Will. “[Many people think] they do not need to evaluate their estate for various reasons such as being young, healthy or even just procrastination,” says Justin Bussoli, an estate lawyer with Carr Law Personal Corporation. However, not having a Will needlessly causes extra time and money to be spent dealing with the estate. “It creates ambiguity and conflict surrounding the beneficiaries of an estate,” adds Joel Sinke, a financial advisor with Edward Jones. When a person passes, the last thing the surviving family members will want to think about is how the estate will be allocated; having a Will makes it so they don't have to worry and give them peace of mind they are acting according to the person's wishes. “First and foremost, a proper Will should always be included in your estate,” says Mark Epstein, the managing partner of Epstein & Associates.

2. Not Naming or Updating Beneficiaries

The beneficiaries are the people who will receive the inheritance once the client has passed away. “In most cases, named beneficiaries supersede the directives expressed in a will,” explains Sinke. Thus, even if the client changes their will to reflect their wishes, the inheritance could still end up in the wrong hands. “A mistake people make with their estate is if they have a Will, it doesn't reflect what they want to happen to their estate,” says Epstein. By regularly updating and reviewing beneficiaries, clients can be reassured that their estate is going to the right hands. “Often people don't properly plan for the death of beneficiary/attorney under a Will or Power of Attorney,” adds Bussoli. If a beneficiary passes away and the estate is not updated, then this can have unexpected consequences. “[This includes] the wrong person receiving an inheritance, unforeseen tax implications and estate having to go through Probate when this could have been avoided,” says Sinke.

3. Not Considering Taxes

“Taxes can be a significant estate expense,” says Sinke. However, they can be mitigated or even avoided altogether. “An effective estate plan and ... using life insurance as a means for planning for the tax burden can be useful in lowering the tax cost to an estate,” Sinke says. With taxes being such a large portion of estate expense it becomes even more imperative to follow the other guidelines above to have plenty of time to work through setting up the estate and Will. “We find people tend to inquire about [a Will and Powers of Attorney] at a time when it may be too late for us to help,” says Bussoli.

Overall, everyone should contact their estate lawyers and financial advisors to set up their estate plan before it is too late. As with most things, this process will take time and the sooner it is started, the better. Nobody wants to leave their loved ones behind with the headache of dealing with the estate and Will when all they should be doing is mourning. “People shouldn't be afraid of calling their lawyer because it's going to cost them money to speak to them,” says Epstein. “They should be more concerned with what the cost will be for failing to make that call.”

Not every personal injury case will make it to the courthouse. Some businesses and persons will prefer to settle it outside of the court, especially if they feel the settlement is fair or don't want to ruin their reputation. However, a client shouldn’t count on that being the case. “In the current climate, many of the major liability insurance companies are denying ‘just’ claims or alternatively giving minimal offers particularly with smaller injury cases,” says William W. Hurst of The Law Office of William W. Hurst. In this case, the lawyer will need to file suit and litigate at least until the trial in order for any sort of fair settlement. “Our lawyer, with the client’s consent, will move quickly and aggressively to begin litigation. A petition is sent out to each defendant... Depositions are set up including mediation,” Gregory H. Herrman of Herrman & Herrman LLP says. If the mediation is unsuccessful, typically the case will go to trial. “In instances where a case goes to court, it’s generally because settlement attempts fail,” explains Jesse Gonzalez of J. Gonzalez Law Firm, “Sometimes the defendant won’t offer a settlement at all or they make a very low offer. At other times, it’s because the defendant and plaintiff can’t come to agreement.” It's hard to look at a case and know ahead of time whether or not a case will go to trial, which is why it’s so important to hire a lawyer that is trial-ready and has experience going to trial. When a case does go to trial, it can be a scary process for the client. That’s why lawyers will spend an enormous amount of time preparing their clients on how to act, how to dress, and what to do. Three Best Rated® sits down with these award-winning lawyers to get advice on what to do if a case goes to court.

Collect Evidence

One of the best things a client can do to help their lawyer (and themselves) is to collect evidence. “There’s a lot that the average citizen can do to prepare for court, but one of the most important is helping your lawyer secure evidence,” Gonzalez says. While it is always best to consult the lawyer on how to collect evidence and what evidence they need, there are still a laundry list of things a client can help with. The client should always save documents pertaining to the case; this includes police statements, work-related reports, medical record and documents of the treatment process, insurance documents and taking notes when speaking to an insurance adjuster. It is also helpful to take photos of the accident, physical trauma, and/or damages to personal property. “[Before the trial] review your discovery responses, medical records, and depositions,” Herrman says. “Your testimony on the stand needs to mirror your previous deposition statements.”

Don’t Admit Guilt

It’s human nature to apologize for an accident, whether it was their fault or not. However, this can end up hurting the client. “It’s important to be aware that admitting fault at any point can jeopardize your claim,” warns Gonzalez. Something as simple as saying sorry for the accident can cause the client to lose their case. Instead, when the client checks on the other party, it should be limited to checking to see if everyone is okay, calling the police, and getting any other necessary information. “You can ruin your auto accident claim by giving too much information to the at-fault driver,” Herrman warns. The client should only give the at-fault driver information on a need-to-know basis.

Stay Away From Social Media

Nearly everyone has some sort of social media where they share their lives with their friends and family. However, in the middle of a case it’s better to stay off social media for a while. “You better believe that the defendant’s lawyer is checking your accounts to see whether or not you are actually hurt,” Gonzalez warns. Posting on social media is often second nature nowadays, so the client might not even think when they post picture, video, or status, but they should! It could come back to haunt them in the courthouse. “I’ve seen plaintiffs who have claimed injury and disability in lawsuits and subsequently post pictures of them water skiing. You can imagine the result,” Hurst says. Is risking a case really worth a couple of comments on social media? Probably not.

The Jury is Watching

In the courthouse, the jury will watch, and notice, everything. “Not only the demeanor and appearance of the clients, but also the appearance, movements, etc. of the attorneys are under scrutiny,” Hurst explains. A good attorney will already know how to appear and act in court and advise their client on how to act also. This includes dressing professionally, acting respectfully, and refraining from outburst or disrespecting the judge and jury. “It is not necessary to be in a suit like your attorney, but you should plan on wearing a nice button up shirt, or a professional looking dress,” says Herrman. “You want to impress your jury!” There’s no need to risk the case needlessly by not trying their best to impress the judge and jury.

Tell the Truth

One of the best ways to lose the case quickly is to be caught in a lie. Even the smallest of lies can cast doubt on the whole case, and will most likely lose. “A case will end quickly if an injured plaintiff who limps into a courtroom is later seen crossing the street from a courtroom window with a perfectly normal gait,” says Hurst. “Hopefully the trial lawyer will discover this about his/her client long before going into Court and terminate the legal relationship.” A client should always be truthful to court and their lawyer. “Hiding previous accidents or previous injuries or medical conditions from your lawyer will adversely affect your claim,” Herrman warns. Being open and honest with the lawyer will help build a stronger case and will increase the likelihood of a fair settlement.

In the end, a client should always talk to their lawyer on what they need to do in a case, and follow their advice. Each case is different and a trusted lawyer will be able to give the best advice for each particular case. The client should hire a lawyer they feel comfortable with and regularly discuss the case and what they, as the injured person, need to do.

Divorce is already a really stressful time for everyone involved. There's a thousand and one different things that have to be discussed, separated, and settled – all while dealing with the pain of losing a marriage. It can especially be stressful when two parties cannot reach an agreement on the divorce terms. This stress can be doubled, or even tripled, if children are involved. Three Best Rated® sits down with three award-winning divorce lawyers to help alleviate this stress and get advice on how to pick the best divorce lawyer for any situation.

1. Hire a lawyer that focuses on family/divorce law

When looking for any type of lawyer, the client will be told to search for a lawyer that specializes in their case. This isn't just a scheme lawyers have to get more money, but extremely important advice. “[Family law] is a complex area of law and you want someone who has practice committed to it,” says Fraser MacLean of MacLean Law Firm. Each field of law has different procedure and stipulations, so hiring a lawyer that specializes in divorce and family law will have intimate knowledge on that particular subject. “When you are divorcing it is not the time to hire a family friend who practices in real estate law... You need a lawyer who not only knows the law, but knows how to work through the court system to resolve your conflict,” Aubrey J. Sherman of Sherman Law LLP explains. A divorce has the potential to change the client’s, ex-spouse’s, and children's lives forever; therefore, it is very important for them to hire the best lawyer for the client’s needs. “The terms of a divorce include child support, spousal support, parenting arrangements and property division,” says Cyndy Morin of Resolve Legal Group. That’s a lot of a client’s life to simply gamble with a lawyer that doesn't specialize in family law. Clients also need to think about the area of expertise the lawyer has; for example, a lawyer that regularly deals with cases that go to trial. “Before a client can even think of hiring a divorce lawyer, they should know what kind of separation and divorce process they want to use,” Sherman explains. “If they want to settle their case amicably, but they hire the biggest most aggressive shark in town, chances are they may end up fighting in court for no reason.”

2. Hire a lawyer with the technical expertise

Clients should hire a lawyer that is familiar with the workings of their case and has a proven success record with dealing with similar cases. “Hire a family lawyer who has experience and success in the exact type of family law case you are involved in,” MacLean explains. “You wouldn't hire a realtor who specialized in selling $100,000 condominiums when you are trying to sell your $10 million mansion. Similarly, if your case is a high-stakes divorce, make sure you hire a lawyer who is familiar with high net worth divorce and separation issues.” The client risks having an unfavorable outcome if the lawyer is unfamiliar with the intricacies of their particular situation. High net-worth marriages and couples are a perfect example of the importance of hiring a lawyer with the correct level of technical expertise. “When spouses with high net-worth, high-value and complex assets are going through a separation and divorce, the standard rules and obligations do not always apply,” Sherman explains. “The manner in which high net-worth spouses manage their financial affairs does not fit well into the system of family law.” Similarly, if a client has children, hiring a lawyer that is used to dealing with childless couples may not be the best choice for them. “When there are children of the marriage/relationship, there are many decisions to be made as to where the children will live, who will make the major decisions for the child and what parenting arrangements need to be made to accommodate the child’s needs,” Morin explains. If a lawyer is unfamiliar with dealing with child custody and access, they may not be able to give the client the best advice on how to move forward with the divorce.

3. Trust your gut feeling

The client should feel comfortable and confident in their lawyer, and trust them. “[If] your gut is telling you to run, you need to listen,” says Sherman. Even if the lawyer sounds perfect on paper, there will be a reason why the client’s gut is telling them to run. The last thing a client wants is to get divorced and then several years later regret their choice of lawyer, because they didn’t feel comfortable enough to clearly communicate their thoughts to the lawyer. Some “red flags” to look for include pushing the client to make decisions they aren't comfortable with, being unprepared, and simply agreeing with everything the client says. In the end, the person who has to live with the outcome of the divorce is the client – not the lawyer. “The lawyer works for them. This is the client’s life,” MacLean says, “The client has a right to choose the process for resolution after being educated as to their choices and informed as to the lawyer’s opinion.” While the client should respect and listen to the lawyer’s advice, in the end, it should be the client’s decision on how to move forward. If a lawyer suggests otherwise, it might be a sign to find a different lawyer. If the lawyer is unprepared and has the client’s files in disarray, this is a huge sign to how the lawyer views the case – and a huge sign it might be time to look for a different lawyer. Finally, the purpose of a lawyer isn’t to simply agree with the client’s every idea. It’s to represent the client in the court of law, and give them advice on the best course of action to take. “You need [a lawyer] who will tell you what you need to know, not what you want to hear,” MacLean explains. In the end, part of trusting the gut feeling is making sure the lawyer fits right with the clients needs and wants, and respects them. “It is important to retain the services of a professional with whom you have a ‘good fit’ as you need to be able to rely on and trust that professional to guide you through what is often one of the most difficult processes that an individual can experience,” Morin adds. This will ensure the whole process goes smoothly and increases the client’s chance for success.

Unfortunately, accidents happen to even the most careful person. It can be especially distressing when a person experiences a debilitating injury through no fault of their own. Insurance companies can deny claims, which will leave the injured person to deal with their medical bills and other expenses alone. Luckily, personal injury lawyers exist for the sole reason of representing people who have been injured and need fair compensation. However, finding a lawyer can be a particularly daunting task. That's why Three Best Rated® sat down with three award-winning personal injury lawyers to learn four mistakes everyone should avoid before hiring a personal injury lawyer.

1. Not Hiring a Personal Injury Lawyer

When dealing with a personal injury case, it's best to hire a personal injury lawyer. “People often make the mistake of thinking that a full-service law firm can handle your case like a focused personal-injury-only firm can,” says James H. Brown of James H. Brown & Associates. “However, there are nuances to this type of law that can be overlooked if you aren't doing it every day, year-round.” Law is vast and complicated; it's impossible to assume one lawyer will know all there is to know about any case. This is why many lawyers will specialize in a field. By focusing on just one area of law, they can gain an intimate knowledge of that particular field, and better serve their clients. “Personal injury lawyers specialize in helping clients who have been hurt through the negligence of others, whether it be from a car accident, slip and fall, product liability, dog bite or nursing home abuse,” explains Patrica Sim of Grillo Barristers. If a client is dealing with a personal injury case and doesn't hire a personal injury lawyer, in the end, they are doing themselves a disservice. In addition, personal injury lawyers have seen a variety of cases and understand how it personally affects a client. “Many people also suffer the after-effects of injuries, including the psychological and emotional effects,” says Steven Polak of Learners Lawyers. “Understanding all of the effects of an injury is an important part of representing an injured person.” By having more experience with these effects, personal injury lawyers are better able to help their clients and be more sympathetic.

2. Not Doing Homework on The Lawyer

Nobody likes doing homework, or most work actually. However, with something as important as hiring a lawyer, it is vital to do research on their potential lawyer. “They should see how long the law firm has been in business, whether they specialize in personal injury, what experience they have with the particular type of accident and injury suffered, and what online reviews the firm has from previous clients,” Sim explains. As with most things, experience is vitally important in law and the more experience a law firm has with particular cases, the better the advice and representation they provide will be. A client should look at the law firm as a whole, and not just a particular lawyer. The lawyer will be able to pull on the collective knowledge from their colleagues to give a client the best representation and advice. On this note, it is important that a client looks at how the firm is perceived by the community and other lawyers. “If the law firm has a bad reputation, then you may not want that taint to possibly impact on your case,” Polak says. It is acceptable for clients to call other practices to ask about the reputation of the law firm they are considering.

3. Not Factoring Geography

Law is a nationwide practice and as such, some firms will have nationwide offices. “However, there is a benefit to having a lawyer who practices in the geographic region where the case happened and has experience in the area,” Brown explains. These local lawyers will be able to pull from experience with the local laws that affect the area, since they consistently deal with cases that have to contend with these laws. “Often, we see people go with national ... groups that don't specialize in Edmonton, or Northern Alberta [where James H. Brown & Associates is located], and these cases can be undervalued by those groups,” Brown adds. By going with a nationwide firm instead of a local one, clients risk getting a smaller settlement due to all the factors discussed.

4. Not Hiring a Lawyer They Trust

One of the most important things a client needs to think about before they hire a lawyer is trust. “They need to trust and feel comfortable with the law firm they choose,” Sim says. The client needs to trust that the lawyer has the client's best interest in mind and genuinely cares about their case. After all, if the lawyer doesn't care about the case, they won't put all their effort into getting a high settlement. “If you're meeting with your lawyer and they're going over things quickly, or aren't thorough, that's likely an indication of how they will be treating your case,” says Brown. When the client comes in for a meeting, their lawyer should take the time to explain everything regarding the case and give thoughtful advice. If the lawyer does not do this, they are laying a poor foundation of trust and the client may want to think about finding a different law firm. “You want a lawyer that is best suited to you and who understands what you are going through,” Polak says.
